CAP Persuades HHS to Relax Rules of Test Reporting

Molecular Testing Labs is a testing facility that works with other healthcare organizations to administer a range of tests including one for COVID-19. Based in Vancouver, Washington, Molecular Testing Labs is a College of American Pathologists (CAP)-accredited facility.

CAP more recently assisted labs in the country with getting the Department of Health and Human Services (HHS) to loosen some of its stringent new rules on lab reporting. CAP’s primary objective is to establish standards for laboratory practices, but it is also an advocate for testing labs in the country.

In early September 2020, the HHS decided to give laboratories more relief and flexibility in meeting data reporting requirements during the pandemic. Prior to this decision, the new rules were viewed as burdensome and the penalties for not complying extremely rigid. The CAP agreed the rules were “unworkable” and appealed to HHS for some relief.

At issue was whether labs had to report both positive and negative results, in addition to other information that was not necessary. The HHS ruled that they would only penalize laboratories that did not report both positive and negative results while also extending them a three-week grace to meet new rules.
